&nbsp;&nbsp;&nbsp;&nbsp;最后，一定要重视现场的管理工作。日常企业就重视现场的安全、文明、卫生管理工作，外审的过程中，企业就更需要注意现场的管理工作了，不能日常做的都很好，外审来了，反而倒退了。岗位员工日常的操作过程中，一定要注意佩戴相关的安全工具，形成一个良好的习惯，休息室的工具箱、现场急救物品的配备一定要齐全，缺了什么要及时配备，这不但是企业现场管理的基本要求，更是外审必审的重点。<br>

&nbsp;&nbsp;&nbsp; 保密协议和竞业限制协议有如下区别：</p>

1、是不是只有机关、事业单位可以享受年休假？<br>
不是。<br>
根据《职工带薪年休假条例》第二条、《企业职工带薪年休假实施办法》第二条、第十七条，除另有规定外，机关、团体、企业、事业单位、民办非企业单位、有雇工的个体工商户等单位的职工，都有权利享受年休假。<br>
<br>
2、所有用工关系职工都享有带薪年休假吗？<br>
不是。<br>
根据《企业职工带薪年休假实施办法》第二条规定，只有与用人单位建立了劳动关系的职工，才能享有带薪年休假。如果是民事关系（如劳务协议、承揽合同等），则不享有带薪年休假，如单位不安排休假也不用支付因未休年休假给与的报酬。<br>

3、特殊劳动关系享有带薪年休假吗？<br>
没有明确规定。<br>
《上海市劳动和社会保障局关于特殊劳动关系有关问题的通知》中规定，特殊劳动关系需要执行的劳动标准：工作时间、劳动保护、最低工资。<br>
其中并未提及同工同酬，可约定。<br>

前12个月剔除加班费后的月平均工资。<br>

根据《企业职工带薪年休假实施办法》第十二条规定，不可以。<br>
但是企业可以通过制定带薪事假的规定来进行操作。<br>

16、用人单位规章制度规定年休假天数、未休年休假工资报酬高于法定标准的可以吗？<br>
可以。<br>
但如果单位没有安排年休假，则应按照高于法定标准补偿职工未休年休假的工资。<br>

17、我们公司有一批派遣人员，可以享受带薪年休假吗？<br>
根据《企业职工带薪年休假实施办法》第十四条规定，可以。<br>
但是如果派遣人员在无工作期间（当年没有进入你们公司之前），派遣单位已经依法支付的报酬天数多于派遣人员全年应享受的年休假天数，不享受带薪年休假。<br>

18、如果单位不安排年休假又不支付未休年休假报酬的，我该怎么办？<br>

统筹安排。<br>
单位有很大的自主权来安排员工的年休假。应该从企业的实际情况出现，将员工的年休假控制在低风险的范围内，例如集体旅游、春节放假，均可以统一安排休年休假。<br>

21、公司规定请事假时如有年休假，则必须先用带薪年休假，合法吗？<br>
合法。<br>
企业有权利统筹安排。<br>
<br>
22、如企业安排我休年休假，但是我工作太忙，实在没空休，我可以获得3倍工资补偿吗？<br>
如果你书面提出不休，就无法获得3倍工资。<br>
根据《企业职工带薪年休假实施办法》第十条规定，“用人单位安排职工休年休假，但是职工因本人原因且书面提出不休年休假的，用人单位可以只支付其正常工作期间的工资收入。”<br>

23、企业需要制定制度来规范企业年休假的实施吗？<br>
需要，且很有必要。<br>

　　人力资源和社会保障部17日发出通知，提出切实措施，强调要把帮助企业渡过难关、稳定就业局势作为当前头等大事来抓。<br>
　　稳定就业局势<br>
　　人力资源社会保障部提出，加强失业调控和失业预警，对本地区可能出现的规模裁员和失业增加等情况，及时向政府报告，并采取措施实施失业预防、调节和控制，全力维持就业局势的稳定。<br>
　　鼓励国有企业带头承担社会责任，尽量减少裁员。对关闭停产企业已解除劳动关系的人员，要及时足额发放失业保险金。同时，还要积极研究失业保险在减轻企业负担和支持困难企业渡过难关方面的政策措施。<br>
　　要配合有关部门结合当地实际，明确本地优先重点发展的劳动密集型行业和企业，完善鼓励发展的资金支持、金融信贷、社会服务等扶持政策，保护和支持劳动密集型产业发展，扩大就业。要全面推动以创业带动就业。<br>
　　重点做好城镇新增劳动力特别是高校毕业生的就业、下岗失业人员和困难群众的就业工作。加大积极就业政策的贯彻落实力度，扩大政策覆盖范围，提高补贴标准，完善操作办法，重点做好关闭停产企业下岗失业人员的再就业工作。<br>
　　此外，要深入企业、深入社区，及时将下岗失业人员纳入登记失业人员范围，在保障其基本生活的同时，落实各项扶持政策，开展有针对性的职业介绍、职业培训等就业服务，促进其尽快实现再就业。<br>
　　要大力开发公益性就业岗位，组织开展公共就业服务和“一对一”就业援助，及时帮助就业困难群众和零就业家庭人员实现就业。不断加强和改进对高校毕业生的就业服务，特别是为困难家庭高校毕业生提供有针对性就业服务，帮助其尽快就业。<br>
　　实施特别职业培训计划。充分运用就业专项资金和失业保险基金，加强对企业职工岗位培训、城镇下岗失业人员的再就业培训和对农民工的技能培训以及对农村初高中毕业生的劳动预备制培训，根据需要延长培训期限，提高培训补贴标准，缓解就业压力，并以此提高技能水平，做好技能人才储备。<br>
　　要结合基本建设项目的开工建设，努力推进校企合作、订单式培训等多种培训模式，增强职业培训的针对性和有效性，为承担各类建设任务的企业提供高素质的技术工人。<br>
　　切实做好社会保障工作<br>
　　人力资源社会保障部提出，稳步提高社会保险待遇。做好2009年企业退休人员基本养老金调整工作，抓紧测算和研究制订方案，加大基金调剂力度，确保调整后的养老金按时足额发放到位。继续调整失业保险金标准和工伤保险待遇，降低医疗保险基金起付线或提高封顶线，以提高保障水平。<br>
　　另外，着力解决各类关闭破产企业和困难企业退休人员参加医疗保险问题，适当降低基本医疗保险和工伤保险费率。<br>
　　具体措施包括，多渠道筹资，努力解决各类关闭破产企业和困难企业退休人员参加医疗保险问题，实行退休人员医疗保险属地管理，其保障待遇与单位缴费脱钩。<br>
　　城镇职工基本医疗保险、工伤保险基金结余规模较大的统筹地区，可采取一次性措施适当降低一定时期的缴费费率，减轻困难企业缴费负担和参保人员费用负担。<br>
　　稳定劳动关系<br>
　　人力资源社会保障部提出，加强对企业劳动关系的指导和服务，建立健全劳动关系调处应急反应机制。<br>
　　要了解企业特别是劳动密集型企业用工动态，及时掌握关闭停产企业劳动关系处理和生产经营困难企业裁员情况。完善应急工作预案，预防和妥善处理群体性事件，做到早发现、早处理、早报告。建立快捷的劳动争议仲裁绿色通道，及时处置重大劳动争议和集体劳动争议。加大劳动争议调解力度，力争将小额、简单、涉及人数较多的劳动争议通过调解化解在基层。<br>
　　要妥善处理工资和工时问题。根据当前经济形势和企业实际，近期暂缓调整企业最低工资标准。区别不同情况，指导符合条件企业及技术先进型服务外包企业实施综合计算工时和不定时工时制。<br>
　　切实做好对农民工的服务工作<br>
　　人力资源社会保障部提出，要引导农民工有序流动，积极开展对农民工的就业服务。<br>
　　具体措施包括，要及时了解本地区在外务工的农民工就业状况和返乡情况，加强对劳动力市场信息的监测和统计，作出分析研判，采取有效措施加以引导。<br>
　　输入地要利用多种途径，及时发布用工信息，将已在用工地稳定就业半年以上失去工作的农民工纳入失业登记，对符合条件的农民工要通过失业保险基金及时核发一次性生活补助，并提供免费的职业介绍和政府补贴的职业培训等就业服务。<br>
　　输出地要依托乡镇劳动保障工作平台，结合当地实际和农民工需求，适应转岗转业和结构调整的需要，大力开展就业培训和创业培训，为返乡农民工就地就业和创业提供服务。<br>

<p><strong>&nbsp;&nbsp;&nbsp;</strong> 新华网消息 人力资源和社会保障部部长尹蔚民9月18日签令公布《企业职工带薪年休假实施办法》，自公布之日起施行。</p>
<p>&nbsp;</p>
<p>　　第一条 为了实施 《职工带薪年休假条例》 （以下简称条例），制定本实施办法。&nbsp;<br>
&nbsp;<br>
&nbsp;&nbsp;&nbsp;&nbsp; 第二条中华人民共和国境内的企业、民办非企业单位、有雇工的个体工商户等单位（以下称用人单位）和与其建立劳动关系的职工，适用本办法。</p>
<p>　　第三条 职工连续工作满12个月以上的，享受带薪年休假 （以下简称年休假）。</p>
<p>　　第四条年休假天数根据职工累计工作时间确定。职工在同一或者不同用人单位工作期间，以及依照法律、行政法规或者国务院规定视同工作期间，应当计为累计工作时间。</p>
<p>　　第五条职工新进用人单位且符合本办法第三条规定的，当年度年休假天数，按照在本单位剩余日历天数折算确定，折算后不足1整天的部分不享受年休假。</p>
<p>　　前款规定的折算方法为： （当年度在本单位剩余日历天数÷365天）×职工本人全年应当享受的年休假天数。</p>
<p>　　第六条 职工依法享受的探亲假、婚丧假、产假等国家规定的假期以及因工伤停工留薪期间不计入年休假假期。</p>
<p>　　第七条职工享受寒暑假天数多于其年休假天数的，不享受当年的年休假。确因工作需要,职工享受的寒暑假天数少于其年休假天数的，用人单位应当安排补足年休假天数。</p>
<p>　　第八条 职工已享受当年的年休假，年度内又出现条例第四条第 （二）、 （三）、（四）、（五）项规定情形之一的，不享受下一年度的年休假。</p>
<p>　　第九条用人单位根据生产、工作的具体情况，并考虑职工本人意愿，统筹安排年休假。用人单位确因工作需要不能安排职工年休假或者跨1个年度安排年休假的，应征得职工本人同意。</p>
<p>　　第十条用人单位经职工同意不安排年休假或者安排职工年休假天数少于应休年休假天数，应当在本年度内对职工应休未休年休假天数，按照其日工资收入的300%支付未休年休假工资报酬，其中包含用人单位支付职工正常工作期间的工资收入。</p>
<p>　　用人单位安排职工休年休假，但是职工因本人原因且书面提出不休年休假的，用人单位可以只支付其正常工作期间的工资收入。</p>
<p>　　第十一条 计算未休年休假工资报酬的日工资收入按照职工本人的月工资除以月计薪天数 （21.75天）进行折算。</p>
<p>　　前款所称月工资是指职工在用人单位支付其未休年休假工资报酬前12个月剔除加班工资后的月平均工资。在本用人单位工作时间不满12个月的，按实际月份计算月平均工资。</p>
<p>　　职工在年休假期间享受与正常工作期间相同的工资收入。实行计件工资、提成工资或者其他绩效工资制的职工，日工资收入的计发办法按照本条第一款、第二款的规定执行。</p>
<p>　　第十二条用人单位与职工解除或者终止劳动合同时，当年度未安排职工休满应休年休假的，应当按照职工当年已工作时间折算应休未休年休假天数并支付未休年休假工资报酬，但折算后不足1整天的部分不支付未休年休假工资报酬。</p>
<p>　　前款规定的折算方法为：（当年度在本单位已过日历天数÷365天）×职工本人全年应当享受的年休假天数-当年度已安排年休假天数。</p>
<p>　　用人单位当年已安排职工年休假的，多于折算应休年休假的天数不再扣回。</p>
<p>　　第十三条劳动合同、集体合同约定的或者用人单位规章制度规定的年休假天数、未休年休假工资报酬高于法定标准的，用人单位应当按照有关约定或者规定执行。</p>
<p>　　第十四条 劳务派遣单位的职工符合本办法第三条规定条件的，享受年休假。</p>
<p>　　被派遣职工在劳动合同期限内无工作期间由劳务派遣单位依法支付劳动报酬的天数多于其全年应当享受的年休假天数的，不享受当年的年休假；少于其全年应当享受的年休假天数的，劳务派遣单位、用工单位应当协商安排补足被派遣职工年休假天数。</p>
<p>　　第十五条 县级以上地方人民政府劳动行政部门应当依法监督检查用人单位执行条例及本办法的情况。</p>
<p>　　用人单位不安排职工休年休假又不依照条例及本办法规定支付未休年休假工资报酬的，由县级以上地方人民政府劳动行政部门依据职权责令限期改正；对逾期不改正的，除责令该用人单位支付未休年休假工资报酬外，用人单位还应当按照未休年休假工资报酬的数额向职工加付赔偿金；对拒不执行支付未休年休假工资报酬、赔偿金行政处理决定的，由劳动行政部门申请人民法院强制执行。</p>
<p>　　第十六条 职工与用人单位因年休假发生劳动争议的，依照劳动争议处理的规定处理。</p>
<p>　　第十七条 除法律、行政法规或者国务院另有规定外，机关、事业单位、社会团体和与其建立劳动关系的职工，依照本办法执行。</p>
<p>　　船员的年休假按 《中华人民共和国船员条例》执行。</p>
<p>　　第十八条 本办法中的 “年度”是指公历年度。</p>
